9 Legal regulation of wild animals in human care Abstract This diploma thesis deals with the legal regulation of wild animals in human care. It outlines the related terminology, legal resources and individual legal provisions that are relevant to the topic of this diploma thesis. It also defines specific ways of the treatment of wild animals, the possibilities of their acquisition into human care and breeding. The diploma thesis in detail analyzes selected entities that breed wild animals. That means rescue stations (specifically their care for handicapped animals), zoos, circuses (namely their training of animals), as well as entities that experiment on animals. For chosen entities, it deals primarily with their obligations under the wild animals legislation. The last part then deals with the issue of liability in relation to wild animals. In the context of civil liability, it means both damage caused by the animal and damage caused to the animal itself. The diploma thesis also deals with administrative offenses based on the Act on the Protection of Animals Against Cruelty and the Act on the Conservation of Nature and Landscape, as well as penalties that can be imposed under these acts. 1 Abstract This Master's thesis entitled Legislation on treating animals in human care compares Czech and Australian legislation in selected aspects of three categories of animals in human care - farm animals, companion animals and animals used for scientific and other research purposes. The thesis is composed of 5 main chapters. The first chapter describes sources of law regarding treating animals in human care from the perspectives of international law, European Union law, federal Czech law and Australian law. The second chapter explains basic terms - an animal and its legal status and animal in human care in Czech and Australian legislation. The third chapter focuses specifically on farm animals as a category of animals in human care as it is detailed in Czech and Australian legislation. The fourth chapter deals with companion animals in both countries' legislation. Finally, the fifth chapter describes the legal protection of animals used for scientific and other research purposes in Czech and Australian legislation. . 1 Abstract Diploma thesis: Legal regulation of the treatment of animals under human care This diploma thesis deals with legal regulation of the treatment of animals under human care at the national, international and European Union levels. It is systematically divided into four main chapters. The first chapter deals with the definition of relevant animal protection concepts, in particular defines the difference between the concepts of animal, creature and wildlife, it also gives an overview of further categorization of animals such as experimental animals, farm animals, animals breed for hobby, handicapped animals, animals that need special care from human, wandering and deserted animals. In my second chapter, I attempted to outline the relationship between national and international law. Firstly is the diploma thesis devoted to presents five most important agreements adopted within Council of Europeat international level, then mentions the Universal Declaration for protection of animals adopted within the United Nations organizations. In other part of the second chapter I devote to legislation at European Union level describing primary and secondary legislation, as well as conceptual tools.
